AUTOMATICALLY UNFAIR DISMISSALS

 
Introduction

1. Participating in a lawful strike or protest action

2. Refusing to do work normally done by an employee participating in a lawful strike or lock out, unless that work is necessary to prevent actual danger to life, personal safety or health

3. A refusal by employees to accept a demand in respect of any matter of mutual interest between them and their employer.

4. As a result of an employee taking action against the employer by exercising any rights conferred by the LRA or participating in any proceedings in terms of the LRA

5. An employee's pregnancy, intended pregnancy, or any reason related to her pregnancy

6. Unfair discrimination

7. A transfer, or a reason related to a transfer, in terms of section 197 or 197A.

8. An employer contravening the Protected Disclosures Act 2000 on account of the employee having made a protected disclosure defined in that Act.
